BE IT ENACTED BY THE CHEROKEE NATION:

Section 1. Title and Codification

This act shall be codified as Title 43, Chapter 5, Office of Child Support Services, and Chapter 6, Child Support Guidelines of the Cherokee Nation Code Annotated.

Section 2. Purpose

The purpose of this legislative act is to amend Title 43 as it relates to the Office of Child Support Enforcement, now Office of Child Support Services and to update the code with necessary changes since the inception of the Office of Child Support Enforcement.

Section 4. Substantive Provisions of Law

§ 500. Office of Child Support Enforcement Services Recognized; Duties

The Legislature Cherokee Nation hereby recognizes the Office of Child Support Enforcement Services ("CSS" or “Office”) of the Department of Justice Human Services Department. The Legislature further recognizes that CSE CSS may enter into contracts within and without the Cherokee Nation for purposes of enforcement of child support orders. In all cases involving unmarried children under the age of eighteen (18) years or through the age of nineteen (19) twenty (20) if regularly attending high school, the Court may order that child support be computed and/or collected by CSE CSS.

1. When the Court orders that child support shall be computed and/or collected by CSE CSS, the parties shall be ordered to provide proof of income to CSE CSS within five (5) ten (10) business days of the court order. If a party does not comply with such order, then all income alleged by the opposing party shall be accepted as true.
