A RESOLUTION AUTHORIZING THE PLACEMENT OF LAND IN TRUST - SOUTHGATE 7.82 ACRES
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, Cherokee Nation acquired property in Cherokee County, Oklahoma containing 7.82 acres, known as Southgate 7.82 acres. This tract encompasses the Asylum Cemetery with 32 unmarked graves, Fleet Services, Wild Land Fire Services, Storage Buildings, Marshal and Chief Vehicle Storage and Career Services. The Southgate 7.82 acres tract is directly across U.S. Highway No. 62 from Sequoyah Schools, a tract of land owned by the United States of America, managed and operated by Cherokee Nation. The southeast corner of the Southgate 7.82 acres tract is less than a quarter mile from Cherokee Nation Trust land and is 0.7 miles northwest of the Cherokee Nation Tribal Complex along U.S. Highway No. 62. The Cherokee County property is further described as follows:

Section 20, A tract of land in the SW4 NW4, more particularly described as follows, to-wit:
COMMENCING at the West Quarter corner of said Section 20;
THENCE, N 0°03'34" W, along the West boundary of said Section 20, a distance of 1319.01 feet;
THENCE, S 89°59'35" E, along the North boundary of said SW4 NW4 a distance of 661.79 feet to the true POINT OF BEGINNING;
THENCE, S 0°02'13" W a distance of 879.79 feet to a point on the Northerly boundary of U.S. Highway No. 62;
THENCE, in a Northeasterly direction along the Northerly boundary of U.S. Highway No. 62, along a curve to the left, having a radius of 11394.16 feet, the chord being N 75°08'10" E a distance of 491.27 feet, an arc distance of 491.31 feet;
THENCE, N 8°41'15" W a distance of 274.79 feet;
THENCE, N 21°16'33" E a distance of 42.28 feet;
THENCE, N 0°54'41" W a distance of 108.95 feet;
THENCE, S 89°48'59" W a distance of 85.82 feet;
THENCE, N 0°07'51" E a distance of 334.00 feet to a point on the North boundary of said SW4 NW4;
THENCE, N 89°59'35" W a distance of 361.30 feet to the true POINT OF BEGINNING.

WHEREAS, Cherokee Nation desires to transfer fee title to United States of America in Trust for Cherokee Nation under the provisions of Title 25 of the Code of Federal Regulations.
BE IT RESOLVED BY THE CHEROKEE NATION, that the Principal Chief of Cherokee Nation, Charles Hoskin, Jr., and/or his authorized designee(s) be authorized to request the Secretary of the Interior to place said tract of land in Trust for Cherokee Nation in accordance with Bureau of Indian Affairs policy and procedure for the acquisition of land.
