A LEGISLATIVE ACT RELATED TO CHEROKEE NATION SUSTAINABLE ENERGY AND RESOURCES - For Discussion Only

BE IT ENACTED BY THE CHEROKEE NATION:
 
Section 1.      Title and Codification
 
      This act shall be known as the "Cherokee Nation Green Act" and codified under (Title) _______________ of the Cherokee Nation Code Annotated (CNCA).
 
Section 2.      Purpose
 
      The purpose of this Act is to establish minimum standards for energy efficiency and conservation for the Cherokee Nation government and its entities.
 
Section 3.      Legislative History
 
      Article VI Section 7 states:  The Council shall have the power to establish laws which it shall deem necessary and proper for the good of the Nation, which shall not be contrary to the provisions of this Constitution.  The style of all bills shall be:  "Be It Enacted By The Cherokee Nation".  The style of all resolutions shall be "Be It Resolved By the Cherokee Nation".
 
Section 4.      Definitions
 
      Cherokee Nation Entities:   Corporations wholly or majority owned by the Cherokee Nation.
 
Section 5.      Substantive Provisions
 
A.      Any and all construction projects that exceed Five Hundred Thousand Dollars ($500,000.00) shall request for proposal on energy efficient technology or green energy study by a professional engineer to implement energy savings.  Said study shall be utilized if efficiency measures are deemed feasible by the Principal Chief  or the appropriate Board of Directors.
 
B.      All maintenance or repair of existing Cherokee Nation building or buildings owned or operated by Cherokee Nation entities shall incorporate energy efficient technologies designed to maximize energy savings.  The Principal Chief or the appropriate Board of Directors shall determine the method to be used.
 
C.      The Cherokee Nation government and its entities shall establish a comprehensive recycling policy designed to reduce waste production.  Said policies shall be determined by the Principal Chief or the appropriate Board of Directors and submitted to the Tribal Council for review.
 
D.      The Cherokee Nation and its entities shall establish a comprehensive water conservation policy designed to minimize water consumption. This plan shall be approved the Principal Chief or the appropriate Board of Directors and submitted to the Tribal Council for review.
 
E.      The Cherokee Nation and its entities shall ensure that all automobile fleets reduce current emissions by 25% by October 1, 2011.  This plan shall be approved by the Principal Chief or the appropriate Board of Directors and presented to the Tribal Council for review.
