COUNCIL OF THE CHEROKEE NATION
A RESOLUTION AUTHORIZING THE CHEROKEE NATION INSTITUTIONAL
REVIEW BOARD FINAL APPROVAL OF RESEARCH PROTOCOLS
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, the Cherokee Nation Council approved Resolution #67-97 establishing the Cherokee Nation Institutional Review Board and bestowing final approval of all research protocols with the Tribal Council; and
WHEREAS, the present flow process for research protocol is often a hindrance to the researcher and may deter researchers from conducting research at Cherokee Nation;
THEREFORE, BE IT RESOLVED BY THE CHEROKEE NATION, that final approval of research protocols will reside with the Cherokee Nation Institutional Review Board, except for those whom the researcher's funding agency secures a resolution and those involving tribal matching funds. The Cherokee Nation Institutional Review Board will report any approved protocols to the Health Committee and Tribal Council.

TITLE:

Narrative: The Cherokee Nation Institutional Review Board was established by the full council in September 1997. Since that time, the Cherokee Nation Institutional Review Board has reviewed approximately 40 research protocols, several publications and abstracts. This has allowed sufficient time and review to recognize that the present flow process is often a hindrance to the researcher and may cause the researcher to conduct research elsewhere that could be beneficial to the Tribe. -.7tfr '7- 17
The original censt ilrian vested final approval for all research protocols with the full council. However, when the Institutional Review Board members grant approval for a protocol, it goes to the Health committee, and then to the full council for final approval. This may take 2 �months for approval due to the scheduled times Health Committee and full council meet.
Researchers are on a time schedule with their funding agencies. For those who are doing short-term projects, i.e., university students on a 5-month semester schedule or those conducting yearly projects, it makes it very difficult to conduct research with the Cherokee Nation. By the time approval is granted, there is little time left to do the research.
The Cherokee Nation Institutional Review Board has the experience and knowledge to make decisions about research protocols that have the potential to benefit the Cherokee People. The board presently consists of 3 Council members who also have oversight and full voting privileges for all research protocols. It is the belief that by granting final approval for research protocols to the Cherokee Nation Institutional Review Board that it would be a benefit to the Tribe not a detriment.
