A RESOLUTION AUTHORIZING CHEROKEE NATION AND CHEROKEE NATION ENVIRONMENTAL PROGRAMS  GROUP TO JOIN THE U.S. EPA'S TRIBAL PESTICIDES PROGRAM COUNCIL
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
 
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
 
WHEREAS, the Cherokee Nation has established the Environmental Protection Commission and the Environmental Programs Group to protect public health, welfare and the environment;
 
WHEREAS, the Cherokee Nation and the Environmental Programs Group participate in the U.S. EPA's Tribal Pesticide Grant Program - Tribal Pesticide Use Assessments (2nd year);
 
WHEREAS, the Cherokee Nation and it's Environmental Programs Group is authorized to participate in the U.S. EPA's Tribal Pesticide Program Council (TPPC);
 
WHEREAS, the U.S. EPA Tribal Pesticide Program Council (TPPC) is a Federal government sanctioned non-partisan/non-lobbying committee authorized under the Federal Advisory Committee Act (FACA);
 
WHEREAS, the U.S. EPA's Tribal Pesticide Program Council (TPPC) is a technical resource and policy group focused on pesticide use and policy regulated under the Federal Insecticide Fungicide and Rodenticide Act (FIFRA-1972); (P.L. 75-717) 7 U.S.C. ยง 136;
 
WHEREAS, participation in U.S. EPA's Tribal Pesticide Program Council (TPPC) will benefit Cherokee Nation, the Environmental Programs Group, and the Cherokee Nation Pesticide Program with knowledge to make informed decisions on tribal pesticide management for protection of public health and the environment;
 
WHEREAS, the Cherokee Nation or Cherokee Nation Environmental Administrator may appoint or approve a member of the Environmental Programs staff to participate in the U.S. EPA's Tribal Pesticide Program Council (TPPC) as an Executive Committee member for a two-year term;
 
WHEREAS, the U.S. EPA Tribal Pesticide Program Council (TPPC) will reimburse Cherokee Nation or provide for any necessary staff travel expenses for two yearly in-person meetings if/when staff are appointed or participate in committee meetings.
 
 
 
BE IT RESOLVED BY THE CHEROKEE NATION, that Cherokee Nation approves joining the U.S. EPA's Tribal Pesticide Program Council (TPPC) and will appoint or approve Executive Committee members as needed to serve on the committee.
