Title
AN ACT RELATING TO THE ESTABLISHMENT OF AN ENVIRONMENTAL CODE FOR THE CHEROKEE NATION

BE IT ENACTED BY THE CHEROKEE NATION that the Cherokee Nation Code providing for an environmental commission and permits and enforcements and procedures related thereto, are hereby adopted as the Cherokee Nation Environmental Act to be codified as Title 3 of the Cherokee Nation Code.
Section 3A-1. Purpose.
The purposes of this act are: to declare a Cherokee Nation Policy which will encourage productive and enjoyable harmony' between human beings and their environment; to enrich the understanding of the ecological systems and natural resources important to the Cherokee Nation.
Section 3A-2. Environmental Code
The Cherokee Nation environmental laws codified herein shall be known as the Cherokee Nation Environmental Code and shall be cited as 63 Cherokee Nation Code Annotated Section 50 et seq.
Section 3A-3. Funding.
The Principal Chief is authorized to submit requests for additional funding to supplement on-going programs or new programs which may become available in the future.
Section 3A-4 Assessment
(a) The base fee currently assessed is twelve-dollars ($12.00) per ton fee for waste disposed at the Cherokee Nation Landfill, and
(b)      on and after October 1, 1993 the base fee will be fourteen-
dollars ($14.00) per ton fee and be sixteen-dollars ($16.00) per ton fee on and after July 1, 1994.
(c) The base fee will be consistent with the recommendations of the currently contracted architectural and engineering study on the landfill to maintain the profitability of the operation.
Section 3A-4. Emergency Declared
It being immediately necessary for the welfare of the Cherokee Nation, the Council hereby declares that an emergency exists, by reason whereof this act and amendments shall take effect and be in full force form and after its passage and approval.
