AN ACT TO REQUIRE CERTAIN TRIBAL POSITIONS OF AUTHORITY TO BE ENROLLED CITIZENS OF THE CHEROKEE NATION

BE IT ENACTED BY THE CHEROKEE NATION:
Section 1. Title and Codification
This act shall be referred as the "Tribal Citizenship Requirement of Key Positions for the Cherokee Nation" and shall be codified as .
Section 2. Purpose
The purpose of this Act is for key position for the Cherokee Nation and job positions who work directly for the Principal Chief of the Cherokee Nation shall be held exclusively by enrolled citizens of the Cherokee Nation.
The positions subject to this legislation are as follows:
a. Principal Chief's General Counsel
b. Principal Chief's Chief of Staff
c. Executive Director of Communications
d. Executive Director of Government Relations
e. Chief Executive Officer of Cherokee Nation Businesses
Section 3. Legislative History
a. "The Council shall have the power to establish laws which it shall deem necessary and proper for the good of the Nation, which shall not be contrary to the provisions of this Constitution."

Section 4. Statutory Provisions
a. The following positions shall be held only by enrolled citizens of the Cherokee Nation:
1. Principal Chief's General Counsel
2. Principal Chief's Chief of Staff
3. Executive Director of Communications
4. Executive Director of Government Relations
5. Chief Executive Officer of Cherokee Nation Businesses
Section 5. Provisions as cumulative
The provisions of this act shall be cumulative to existing law.
Section 6. Severability
The provisions of this act are severable and if any part of provision hereof shall be held void the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this act.
Section 7. Emergency Declared
It being immediately necessary for the welfare of the Cherokee Nation, the Council hereby declares that an emergency exists, by reason whereof this Act shall take effect and be in full force after its passage and approval.
