A RESOLUTION AUTHORIZING TRANSFER OF TRUST LAND TO CHARLES STILWELL IN FEE
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
 
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
 
WHEREAS, Cherokee Nation, has acquired property located in Adair County owned United States of America in Trust for Cherokee Nation. Said property was purchased in July of 1937 pursuant to the provisions of Section 1 of the Oklahoma Act of June 26, 1936;
 
WHEREAS, Cherokee Nation has established the Malloy Hollow housing subdivision on a part of this acquired property in Adair County.   Cherokee Nation desires to transfer a tract of Trust land adjoining the Malloy Hollow housing subdivision in fee status to Charles Stilwell, a Cherokee Nation citizen.  The 1.23 acre tract lies along the northwestern boundary of Tract 8 in the Malloy Hollow subdivision.  The property is further described as:
 
A tract of land situated in the N/2 of Section 9, T14N, R24E, I.B.&M., Adair County, Oklahoma, described as follows:
Commencing at the N/4 Corner of said Section; thence S00°08'22"W along the ¼ section line a distance of 1,083.47 feet to the POINT OF BEGINNING, said point being on the South R/W line of a County Road;
Thence N87°01'14"E along said R/W line a distance of 59.92 feet to the point of curve of a non tangent curve to the right, of which the radius point lies S02°19'48"W, a radial distance of 118.46 feet; thence southeasterly along the arc, through a central angle of 45°51'28", a distance of 94.81 feet; thence S46°53'48"E along said R/W line a distance of 67.47 feet; thence S38°31'58"W and leaving said R/W line a distance of 228.43 feet to the centerline of another County Road; thence N42°02'35"W along said centerline a distance of 274.69 feet; thence N44°05'40"W along said centerline a distance of 112.75 feet; thence N83°28'32"E and leaving said centerline a distance of 32.68 feet to the South R/W line of a County Road; thence S73°40'52"E along said R/W line a distance of 25.00 feet to the point of curve of a non tangent curve to the left, of which the radius point lies N19°33'57"E, a radial distance of 377.18 feet; thence easterly along the arc, through a central angle of 20°50'23", along said R/W line a distance of 137.19 feet; thence N87°01'14"E along said R/W line a distance of 21.00 feet to the POINT OF BEGINNING, Containing 1.23 acres, more or less...Basis of Bearings: True North.
 
WHEREAS, Cherokee Nation desires to transfer title from United States of America in Trust for Cherokee Nation to Charles Stilwell in fee status, under the provisions of Title 25 of Code of Federal Regulations.
 
BE IT RESOLVED BY THE CHEROKEE NATION, that the Principal Chief of Cherokee Nation, Bill John Baker, and/or his authorized designee(s) be authorized to request the Secretary of the Interior to transfer the above tract of real property to Charles Stilwell, a Cherokee Nation citizen, in fee status, in accordance with Bureau of Indian Affairs policy and procedure for the acquisition of land.
