RESOLUTION NO.67 .97

Authorizing the Health Services Division to establish a Tribal Review Board to review health research proposals involving the Cherokee Nation prior to Tribal Council Review.

WHEREAS: the Cherokee Nation has exercised the sovereign rights of self-government on behalf of the Cherokee people, and;

WHEREAS: the Cherokee Nation is a federally recognized Indian Nation with an historic and continual government to government relationship with the United States of America, and;

WHEREAS: the Cherokee Nation has always sought the protection and rights of tribal members;

WHEREAS: the Cherokee Nation receives numerous requests for health research projects involving the Cherokee Nation;

WHEREAS: a Tribal Review Board will set forth conditions to which research can be conducted;

WHEREAS: the Tribal Review Board will insure the protection of the rights and welfare of tribal members involved in the research and will insure that research is for the benefit of the Cherokee people and will pose no unnecessary risks;

WHEREAS: a Tribal Review Board will have full authority to recommend approval or disapproval on requests for research proposals and to monitor approved research projects;

WHEREAS: the Tribal Review Board members will have representation from professionals in health care, law and justice, the community, and tribal administration;

NOW THEREFORE BE IT RESOLVED that the Council of the Cherokee Nation do fully support the authorization for the establishment of a Tribal Review Board and to exercise full power to receive, review, recommend action and monitor research proposals and projects in the Cherokee Nation Health Services Division.

CERTIFICATION

The foregoing resolution was adopted by the Council of the Cherokee Nation at a duly called meeting on the 11TH day of  AUGUST, 1997, having  14  members present, constituting a quorum, by the vote of  14 yea,  a  nay,  0 abstaining.

TITLE OF RESOLUTION:                     Authorizing the establishment of a Tribal Review Board with full authorization to coordinate research activities involving Cherokee Nation: to receive, review, recommend action to the Tribal Council and monitor health related research.

C                     NARRATIVE:                     This resolution authorizes the Health Services Division to establish a Tribal Review Board with full authority to receive, review, recommend action and monitor health research projects. The main purpose of the TRB will be to protect the rights and welfare of tribal members and of the tribe involved in any research project. The TRB will insure that any research project will benefit the tribe.

SUBJ: Resolution to Establish a Tribal Review Board

Earlier this year a resolution to establish a Tribal Review Board for health related research was submitted for approval. However, there was some last minute objection and the proposed action was never brought to the Council for a vote. I have amended the proposal to make the Tribal Review Board a recommending group to the Council. I believe this will satisfy the need to coordinate the proposed activities of health related research.

If there is no administrative objection, I will put this on the Health Committee agenda for July. The proposed resolution is attached.
