A RESOLUTION ADOPTING A MAINTENANCE AND OPERATING POLICY AND ESTABLISHING A SET ASIDE FOR M&O CONTINGENCIES TO THE U.S DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT COMMUNITY BUILDING APPLICATION
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
 
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
 
WHEREAS, the Cherokee Nation has a responsibility to promote the well being of its citizens;
 
WHEREAS, the Cherokee Nation covers a huge geographic area extending over 14 counties in Northeast Oklahoma;
 
WHEREAS, much of the Cherokee population is organized into rural communities that are distinct and unique;
 
WHEREAS, the Cherokee Nation is committed to self help projects that assist in building stronger, safer communities in which Cherokee pride and community relationships are strong;
 
WHEREAS, the U.S. Department of Housing and Urban Development (HUD), through the Indian Community Development Block Grant (ICDBG) program has available competitive monies for community facilities that would allow low and moderate income Cherokees to receive services and strengthen communities;
 
WHEREAS, HUD requires that monies be set aside as funds for operational and maintenance funds for community building projects;
 
WHEREAS, community organizations who will manage the community buildings will also take formal responsibility for utilities and upkeep of buildings after construction;
 
WHEREAS, said commitments by the community organizations must be backed up by an amount sufficient to cover any construction oversight or community defaults;
 
WHEREAS, HUD requires the adoption of a Maintenance and Operation policy that in the case of Cherokee Nation will be supplemental to the individual plans provided by the relevant community non-profit with management responsibility for the buildings.
 
BE IT RESOLVED BY THE CHEROKEE NATION, that the Council does adopt the Maintenance and Operation Policy attached and incorporated by reference herein.
