A LEGISLATIVE ACT AMENDING TITLE 19 “COUNCIL” §11 OF THE CHEROKEE NATION CODE ANNOTATED, AS AMENDED BY LEGISLATIVE ACT #4-95; RELATING TO ESTABLISHMENT OF STANDING COMMITTEES; AND DECLARING AN EMERGENCY

BE IT ENACTED BY THE CHEROKEE NATION:
Section 1. Title:
This act shall be known as the “Council Standing Committee Amendment Act of 2007” and shall be codified at Title 19 Chapter 2 Section 11 of the Cherokee Nation Code Annotated.
Section 2. Purpose
The purpose of this Act is to consolidate standing committees of the council in order to remove duplication of reporting and oversight. This Act will consolidate the Employment Committee with Executive & Finance Committee, and combine the Education Committee with the Language, History and Culture Committee.

Title 19 CNCA § 11; Legislative Act #4-85 effective 7/13/85, as amended by Legislative Acts 27-88 effective 6/11/88, 32-89 effective 6/10/89, 14-91 effective 9/14/91, and 4-95 effective 8/14/95.
Section 4. Amendment
19 CNCA, Chapter 2 § 11 is hereby amended as follows:
§ 11. Standing Committees-Establishment
The following Standing Committees of the Council are hereby established:
A. Community Services
B. Rules Committee
C. Resources Committee
D. Executive & Finance Committee
E. Education and Culture Committee
F. Health Committee
19 CNCA, Chapter 2 § 13 is hereby amended as follows:
§ 13. Same---Duties
The Council shall define the jurisdiction and duties of the Standing Committees in the Rules of Procedure Governing the Tribal Council.
Section 6. Provisions as cumulative
The provisions of this act shall be cumulative to existing law.
Section 7. Severability
The provisions of this act are severable and if any part of provision hereof shall be held void the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this act.
Section 8. Emergency Declared
It being immediately necessary for the welfare of the Cherokee Nation, the Council hereby declares that an emergency exists, by reason whereof this act shall take effect and be in full force after its passage and approval.
Section 9. Self-Help Contributions
To the extent that this Act involves programs or services to citizens of the Nation or others, self-help contributions shall be required, unless specifically prohibited by the funding agency, or a waiver is granted due to physical or mental incapacity of the participant to contribute.
