AUTHORIZING THE APPROVAL OF A BUSINESS LEASE BETWEEN CHEROKEE NATION AND THE KENWOOD COMMUNITY ASSOCIATION ON TRUST LAND

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, the Kenwood Community Association has submitted a request to lease the trust unit in Kenwood, consisting of approximately twelve acres, for another five (5) years for $1.00 per year for the Kenwood Community Building and the Ballpark area in Delaware County;
WHEREAS, that the Real Estate Services Department prepare the necessary documents to grant a lease with the Kenwood Community Association and to waive the appraisal because of the nominal rental amount;
WHEREAS, the Kenwood Community Association to be responsible for the maintenance and upkeep of the building and ballpark.
BE IT RESOLVED BY THE CHEROKEE NATION, that the Tribal Council, in order to improve efficiency, grants the Cherokee Nation Real Estate Services Department authority to lease the Kenwood Community Building and Ballpark to the Kenwood Community Association for five years for $1.00 per year pursuant to the regulations found in 25 CFR, Part 162, to waive the appraisal and that Chad Smith, Principal Chief (or his designee) be authorized to negotiate and execute all official matters in this regard.
