AN ACT AMENDING CHEROKEE NATION CODE ANNOTATED TITLE 12 “CIVIL PROCEDURE” TO CREATE THE CHEROKEE NATION VICTIM PROTECTION ACT

BE IT ENACTED BY THE CHEROKEE NATION:

 

Section 1.                     Title and Codification

 

This Act shall be codified at CNCA Title 12 “Civil Procedure” and be known as the “Cherokee Nation Victim Protection Act of 2026”

 

Section 2.                     Purpose

 

The purpose of this act is to enhance victim protection by prohibiting publication of certain case documents on the Cherokee Nation District Court website; providing an exception; providing for codifications.

Section 4.                     Substantive Provisions

 

Title 12 of the Cherokee Nation Code Annotated is hereby amended by adding a new section, 12 CNCA Chapter 1 § 9, to read as follows:

 

§ 9. Specific Charges Not to Be Posted on Court-Controlled Website.

A. No court clerk of the Cherokee Nation shall publish on a court-controlled website any document in a case that contains a charge involving rape, sodomy, sex crimes, sexual images, lewd or indecent conduct, pornography, child abuse or neglect, domestic abuse, kidnapping, extortion of a vulnerable victim, human trafficking, or similar offenses, including but not limited to those offenses codified at 21 CNCA §§ 644, 741, 843.1, 843.5, 885, 886, 888, 1021, 1021.2, 1021.3, 1040.13a, 1081, 1085, 1087, 1088, 1111, 1113, 1116, and 1123.

B. Nothing in this section shall be construed to prohibit access to any original document as provided by law.

 

 

Section 5.                     Provisions as cumulative

 

The provisions of this act shall be cumulative to existing law.

 

Section 6.                     Severability

 

The provisions of this act are severable and if any part ofor provision hereof shall be held void the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this act.

 

 

Section 7.                     Effective Date

 

The provisions of this act are effective at the date of its passage and are not retroactive.
