A RESOLUTION AUTHORIZING CHEROKEE NATION TO LEASE TRIBAL TRUST LANDS FOR AGRICULTURAL USE INSIDE THE CHEROKEE NATION RESERVATION BOUNDARY AND TRUST LANDS AT CHILOCCO IN KAY COUNTY, OKLAHOMA

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, the Cherokee Nation has designated certain areas of Trust land for farming, grazing and hay to be leased out for Agricultural purposes inside the Cherokee Nation Reservation Boundary as well as Trust lands at Chilocco in Kay County, Oklahoma;
WHEREAS, the Cherokee Nation Real Estate Services requests the tribal Council to issue a waiver of said regulation requiring surety bonds on Cherokee Tribal Land Leases. Pursuant to regulations contained in 25 CFR 162.203(b)(2) waives the requirement for a bond by tribal resolution. Cherokee Nation has determined that a waiver of performance bond or alternative form of security is in the best interest of the tribe, and;
WHEREAS, The Cherokee Nation will determine a fair annual rental by competitive bidding and pursuant to 25 CFR ยง162.211(a) no appraisal or other appropriate valuation method is needed. The Tribe feels that negotiated values and the use of competitive bids are in the best interest of the Cherokee Nation and that:
1. Cherokee Nation has negotiated compensation satisfactory for the tribe.
2. Cherokee Nation waives valuation via an appraisal or other valuation method; and
3. Cherokee Nation has determined that accepting such bids or negotiated compensation and waiving valuation is in the best interest of the tribe.
