BE IT ENACTED BY THE CHEROKEE NATION:
 
Section 1.      Title and Codification
 
This act shall be known as the "Employee Bonus Re-appropriation Act of 2009" and, given the Acts singular nature, no codification is necessary.
 
Section 2.      Purpose
 
The purpose of this Act is to re-appropriate one million five hundred thousand dollars ($1,500,000.00) to employee bonuses, which represents the amount vetoed by Principal Chief Smith from Legislative Act 16-07.  The Cherokee Nation District Court ruled that said "Line item veto" was unconstitutional.

Section 4.      Definitions
 
            For the Purposes of this Act:
 
A.      Eligible Employee:      Means those individuals employed by the Cherokee Nation during fiscal year 2007.
 
Section 5.      Substantive Provisions
 
A.      One million five hundred thousand dollars ($1,500,000.00) shall be appropriated for FY 2007 employee bonuses.  Said funds shall be divided equally among eligible employees.
 
B.      The source of these funds shall be the FY 2009 contingency fund.
 
 
 
 
Section 6.      Provisions as cumulative
 
      The provisions of this act shall be cumulative to existing law.
 
Section 7.      Severability
 
      The provisions of this act are severable and if any part of provision hereof shall be held void the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this act.
 
Section 8.      Effective Date
 
      This act shall become effective __________________________, 2009, in accordance  with the Cherokee Nation Constitution.
