A RESOLUTION RATIFYING LITIGATION IN THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF OKLAHOMA

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with an historic and continual government to government relationship with the United States of America;
WHEREAS, 73 CNCA § 201, et seq. provides that litigation brought on behalf of Cherokee Nation and involving the sovereignty of the Nation, including treaty rights, be authorized by the Principal Chief and ratified by the Council;
WHEREAS, circumstances have arisen in which certain parties have taken or attempted to take actions that infringe upon, diminish, or otherwise impair the sovereign rights and interests of the Nation;
WHEREAS, in order to preserve the rights of the Nation and to prevent further harm to the Nation’s sovereignty, it was necessary to initiate litigation in the United States District Court for the Northern District of Oklahoma seeking appropriate declaratory, injunctive, and/or other relief against Kevin Stitt, the Oklahoma Department of Wildlife Conservation, and special prosecutors;
WHEREAS, the Council of the Cherokee Nation desires to formally ratify the initiation, continuation, and pursuit of such litigation as necessary and proper for the protection of the Nation’s sovereign interests and the exercise of its inherent governmental powers;
NOW THEREFORE BE IT RESOLVED BY THE CHEROKEE NATION, that the initiation, continuation, and pursuit of such litigation, and any related legal actions, appeals, and/or proceedings undertaken to preserve and protect the sovereign interests of the Nation is hereby ratified, affirmed, and approved in all respects; and
