A RESOLUTION AUTHORIZING CHEROKEE NATION TO LEASE A PORTION OF TRIBAL TRUST LAND TO THE AMO HEALTH CENTER IN SALINA TO THE CITY TOWN OF SALINA AND TO SUPPORT THE RESERVATION UNLEASED PORTIONS IN SUPPORT OF CHEROKEE NATION COMMUNITY, CULTURE AND LIFEWAYS, PROGRAMS OR SERVICES INCLUDING TO LEASE A PORTION TO THE OLD SALINE CHEROKEE ASSOCIATION
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people; and,
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America; and,
WHEREAS, the City of Salina wishes to lease a portion of the Amo Health Center and parking lot. The term of the lease and annual rent will be negotiated between the Cherokee Nation and the City Town of Salina, with a potential option to renew. The tract of land is located in part of the SW NW in Section 14, Township 21 North, Range 20 East, I.B.&M. Mayes County Oklahoma; and,
WHEREAS, the Principal Chief has determined that the portion of the facility not leased to the Town of Salina pursuant to this resolution should be used in support of Cherokee Nation community, culture and lifeways, including but not limited to provided community gathering space for Cherokee Nation citizens, programs and services and all or a portion of such space should be leased to the Old Saline Cherokee Association, a non-profit organization that participates with the Cherokee Nation Community and Cultural Outreach department on terms customary with other leases to such organizations; and,
WHEREAS, the Cherokee Nation requests an extended lease term for the business lease and any other leases executed pursuant to this resolution, pursuant to 25 USC 415(A); and,
WHEREAS, Cherokee Nation Real Estate Services requests the Council of the Cherokee Nation to issue a waiver of said regulation requiring bonds on Cherok...
