A RESOLUTION AUTHORIZING CHEROKEE NATION TO SUBMIT FORMAL GRANT APPLICATIONS TO THE UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES FOR TRIBAL SELF-GOVERNANCE PROGRAM PLANNING/NEGOTIATION COOPERATIVE AGREEMENTS

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, Federal health services to maintain and improve the health of American Indians are constant with and required by the Federal Government’s historical and unique legal relationship with, and resulting responsibility to, the American Indian people, 25 U.S.C. § 1601(a);
WHEREAS, the Cherokee Nation provides comprehensive, integrated, and Tribally-controlled health care services directly, by retaining certain programs with the Indian Health Service, and through purchasing other services;
WHEREAS, on January 15, 2008 Cherokee Nation announced a Self-Governance planning process regarding the operation of all applicable programs, services, functions and activities (PSFAs) at W.W. Hastings Indian Hospital as authorized under the Indian Self-Determination and Education Assistance Act;
WHEREAS, Department of Health and Human Services, Indian Health Services announced two funding opportunities: (1) HHS-2008-IHS-TSGP-0001, Tribal Self-Governance Program Negotiation Cooperative Agreement Grant in the amount of $20K, and (2) HHS-2008-IHS-TSGP-0002, Tribal Self-Governance Program Planning Cooperative Agreement Grant in the amount of $50K;
WHERAS, the purpose is to award cooperative agreements that provide planning/negotiation resources to Tribes interested in participating in Tribal Self-Governance Program.
