A RESOLUTION RESCINDING PREVIOUS COUNCIL RESOLUTION #63-06

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people; and,
WHEREAS, the Constitution of the Cherokee Nation was approved by the Commissioner of Indian Affairs on September 5, 1975, seconded by Principal Chief Ross O. Swimmer on October 2, 1975, and ratified by the Cherokee people on June 26, 1976; and,
WHEREAS, on the ____ day of _____, 2006, the Cherokee Nation Tribal Council passed Resolution #63-06 which authorized a vote of the people on the constitutional amendment which would define and set forth requirements for citizenship in the Cherokee Nation; and
WHEREAS, the Cherokee Nation is aware of certain Court actions that would bring to question the CN ability to go forward with a vote whose result may disenfranchise a segment of Cherokee citizens; and
WHEREAS, it is prudent that the Cherokee Nation voluntarily with hold any vote on any amendment to the Cherokee Nation Constitution until such time that these Court issues are resolved; and
NOW, THEREFORE, BE IT RESOLVED by the Cherokee Nation through its Tribal Council that Council Resolution #63-06, which authorized a vote of the people for a Constitutional amendment defining citizenship and defining requirements is hereby rescinded.
