A RESOLUTION SETTING THE DATE FOR THE SWEARING-IN OF THE NEWLY ELECTED COUNCIL MEMBER FOR DISTRICT 11
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people; and,
 
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America; and,
 
WHEREAS, a special election has been set for October 12, 2013 to fill a Council Vacancy for District 11; and,
 
WHEREAS, Title 26, Section 51, C provides procedures and setting of special dates for a special election; and,
 
WHEREAS, the Cherokee Nation Election Commission has set the special election timelines for all election activities from the first election, possible run-off election date, recounts, challenges and appeals except for the swearing-in; and,
 
WHEREAS, the Cherokee Nation Election Commission has suggested the following dates for swearing-in the new District 11 Council Member of October 22, 2013, if there is no recount, no runoff and no challenges and if a runoff, or recount or challenges occur, and an alternate date of November 13, 2013 will be set, if there is a run-off and if there is no recount or challenges; and, therefore,
 
BE IT RESOLVED BY THE CHEROKEE NATION, the Council of the Cherokee Nation hereby sets October 22, 2013, for the swearing-in of the new District 11 Council Member, if there is no recount, no runoff and no challenges; and, if there is a runoff or recount or challenges occur, an alternate swearing in date of November 13, 2013 will be set so long as there is no recount or challenges for the runoff; and if a runoff, recount or challenge occurs, a new swearing in date will be set by the Council afterwards.
