Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
 
WHEREAS, the Cherokee Nation a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
 
WHEREAS, various utility and road construction companies desire permission to place access roads, on ramps, & various utilities and service line agreements for the benefit of Cherokee Casino Catoosa, more particularly described as:  
 
All that part of the USA in Trust land for the Cherokee Nation located in Block 1 & Block 2 of Port Place an Addition to the City of Catoosa, Rogers County, Oklahoma;  
 
WHEREAS, Cherokee Nation waives compensation, as the utility & access easements and service line agreements will service the Cherokee Catoosa Casino and for the use and benefit of the Cherokee Nation;
 
WHEREAS, 25 CFR § 169 & 25 CFR § 169.22 (b) states agreement shall be executed by and between the tribe or legally authorized occupant and the applicant before any work by the applicant may be undertaken for the construction of a Right of Way Easement and/or service line across tribal land.
 
        BE IT RESOLVED BY THE CHEROKEE NATION, that the person(s) authorized to sign required documents necessary to execute said Right-of-Way easements or Service Line Agreements be Chad Smith, Principal Chief of the Cherokee Nation, and/or his authorized designee(s).
