A RESOLUTION AUTHORIZING THE ENVIRONMENTAL PROGRAMS GROUP TO SUBMIT AN APPLICATION TO THE U.S. ENVIRONMENTAL PROTECTION AGENCY FOR A MUNICIPAL SOLID WASTE PROJECT
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised sovereign rights of self-government in behalf of the Cherokee people;
 
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
 
WHEREAS, the Cherokee Nation has established the Environmental Protection Commission and the Environmental Programs Group to protect public health, welfare and the environment;
 
WHEREAS, the Cherokee Nation has previously received funding from the EPA Solid Waste Program;
      
WHEREAS, with the award of proper funding, the Cherokee Nation's Inter-Tribal Environmental Council (ITEC) Municipal Solid Waste Project will continue to provide ITEC member tribes with assistance for managing municipal solid waste;
 
WHEREAS, this assistance will include the distribution of a generic tribal solid waste management plan, including tribal codes and regulations pertaining to solid waste, developing and conducting trainings addressing tribal solid waste issues.
 
      BE IT RESOLVED BY THE CHEROKEE NATION, that the Cherokee Nation Council hereby authorizes the Environmental Programs Group to submit a formal application to the U.S. Environmental Protection Agency for a 2008 Municipal Solid Waste Project, and that the Principal Chief (or his designee) shall be authorized to conduct contract negotiations and execute all official documents in this regard.
