A RESOLUTION AUTHORIZING THE RESCISSION OF RESOLUTION NO. 90-06 AND AUTHORIZING APPROVAL OF A LEASE BETWEEN CHEROKEE NATION AND THE PARK HILL COMMUNITY ORGANIZATION TO CONSTRUCT THE PARK HILL COMMUNITY BUILDING ON THE OWENS SCHOOL FEE PROPERTY

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, Cherokee Nation Real Estate Services is requesting to rescind Resolution 90-06, dated September 19, 2006, which was the authorization for the Park Hill Community Organization to construct a community building next to the Ross School but, as the grounds were not adequate for a building, and with the recent acquirement of the Owens School, this site will be a superior location;
WHEREAS, Park Hill Community Organization has submitted a proposal for a Lease for the fee property at the Owens School containing approximately 1 acre, Park Hill, Oklahoma, Cherokee County, for one dollar ($1.00) a year for fifty years to rehabilitate and construct a community building next to the Owens School.
BE IT RESOLVED BY THE CHEROKEE NATION, that the Tribal Council, in order to improve efficiency, grants the approval to rescind Resolution 90-06 and to authorize Cherokee Nation Real Estate Services Department authority to lease the Owens School property at Park Hill in Cherokee County for one dollar a year for fifty years with and the proper documents be prepared to the Park Hill Community Organization and that Chad Smith, Principal Chief (or his designee) be authorized to negotiate and execute all official matters in this regard.
