A RESOLUTION RECOMMENDING REQUIREMENTS FOR SUPREME COURT JUSTICE APPOINTMENTS AND REQUEST FOR COMMENT FROM THE CHEROKEE NATION JUDICIAL BRANCH

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, the Council of the Cherokee Nation wishes to ensure that the Cherokee Nation can exercise its sovereignty to the greatest extent allowed by law;
WHEREAS, the Council of the Cherokee Nation finds that individuals with training and experience that are unique to Federal Indian law and to the Cherokee Nation’s tribal laws, customs, traditions and judicial system are the best qualified to ensure tribal sovereignty is exercised to the greatest extent allowed by law;
WHEREAS, the Council of the Cherokee Nation desires to promote and improve Indian jurisprudence in the Cherokee Nation tribal court systems;
WHEREAS, the Council of the Cherokee Nation seeks to ensure only the most qualified candidates are appointed to the Cherokee Nation’s highest judicial court;
WHEREAS, the Council of the Cherokee Nation recommends that Supreme Court justice appointments be admitted to practice law in Cherokee Nation tribal court through the Cherokee Nation Bar Association for not less than one (1) year;
WHEREAS, the Council of the Cherokee Nation requests input and feedback from the Cherokee Nation Supreme Court to identify and recommend ways to improve Indian jurisprudence in the Cherokee Nation tribal courts.
BE IT RESOLVED BY THE CHEROKEE NATION, that the Council of the Cherokee Nation hereby recommends that Supreme Court justice appointments be admitted to practice law in Cherokee Nation tribal court through the Cherokee Nation Bar Association for not less than one (1) year;
