AN ACT REJECTING THE RECOMMENDATIONS OF THE CITIZENS COMMITTEE ESTABLISHED UNDER LEGISLATIVE ACT 05-11 WHICH CALLS FOR A PAY INCREASE FOR ELECTED OFFICIALS

BE IT ENACTED BY THE CHEROKEE NATION:
 
 
Section 1.      Title and Codification
 
      This Act shall be known as "The No Pay Raise for Elected Officials Act of 2011" and shall be codified under Title 19 and 51 of the Cherokee Nation Code Annotated.
 
Section 2.      Purpose
 
      The purpose of this Act is to ensure that elected officials of the Cherokee Nation do not receive a pay raise beginning in August of 2011.

Section 4.      Definitions
 
1.  Citizens Commission:  means the commission of Cherokee Citizens created under LA 42-03
 
2.  Elected Official: means the duly elected Principal Chief, Deputy Chief and Tribal Council members of the Cherokee Nation.
 
Section 5.      Substantive Provisions.
 
In accordance with Legislative Act 05-11, the pay increase recommended by the Citizen's commission which would result in increased salaries for elected officials of the Cherokee Nation is not adopted and shall not go into effect in August of 2011.
 
 
 
Section 6.      Provisions as cumulative
 
      The provisions of this act shall be cumulative to existing law.
 
Section 7.      Severability
 
      The provisions of this act are severable and if any part of provision hereof shall be held void the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this act.
 
Section 8.      Effective Date
 
      This act shall become effective after its passage in accordance with the Cherokee Nation Constitution.
