AN ACT AMENDING LA 36-02 TO ADD TWO ADDITIONAL ADVISORY BOARD OF DIRECTORS TO THE CHEROKEE NATION HOUSING AUTHORITY

BE IT ENACTED BY THE CHEROKEE NATION:
 
      Section 1.      Title.
 
This Act shall be known as the "Cherokee Nation Housing Authority Advisory Board
Amendment Act."
 
      Section 2.       Purpose.
 
The purpose of this Act is to establish an  increase the number of Advisory Board of Directors consisting of members of the Cherokee Nation Tribal Council.
 
      Section 3.      Legislative History.
 
A.      Article V Section 7 of the Cherokee Nation Constitution.
 
      Section 4.       Substantive Provisions.
 
A.      There shall be an advisory board of directors to the Cherokee Nation Housing Authority. This advisory board shall consist of three (3) five (5) members of the Cherokee Nation Tribal Council. The Tribal Council shall appoint these members in accordance with their rules and procedures. The advisory board shall have full access to all information and meetings of the Board of Directors and have all privileges of the Board of Directors except voting privileges.
 
1.  That once this Amendment is passed a regular agenda item will be included in the monthly Community Services Committee Meeting so that the members of the Council who serve on the Cherokee Nation Housing Authority Advisory Board can provide the full Council Committee with a monthly report in addition to the Cherokee Nation Housing Authority Director.
 
      Section 5.       Severability.
 
The provisions of this Act are severable and if any part of provision hereof shall be held void or invalid by a court of competent jurisdiction the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this Act.
 
      Section 6.       Declaration of emergency.
 
It being immediately necessary for the welfare of the Cherokee Nation, the Council hereby declares that an emergency exists, by reason whereof this Act shall take effect and be in full force after its passage and approval.
