AN ACT RELATING TO CHEROKEE NATION GUARDIANSHIP AND CONSERVATORSHIP CODE

BE IT ENACTED BY THE CHEROKEE NATION:

Section 1. Title and Codification

This Act shall be known and may be cited as the Cherokee Nation Guardianship and Conservatorship Act of 2012. This Act shall be codified at Title 30, Section 1 et seq. of the Cherokee Nation Code Annotated.

Section 2. Purpose

It is the purpose of this Chapter to promote the general welfare of minor Cherokee Nation citizens or minors eligible to be Cherokee Nation citizens by establishing a system of general and limited guardianships for minors which provides for the protection of their rights and the management of their financial resources.

Section 4. Substantive Provisions of Law

Title 30 of the Cherokee Nation Code Annotated is hereby ratified as follows:

Guardianships
§1. Short Title - Codification
This Act shall be known and may be cited as the Cherokee Nation Guardianship and Conservatorship Act of 2012. This Act shall be codified at Title 30, Section 1 et seq. of the Cherokee Nation Code Annotated.
§2. Purpose

§3. Existing guardianships or conservatorships-Compliance with Act
1. Any guardianship or conservatorship in existence on or created on or after the effective date of this Act shall comply with the provisions of the Cherokee Nation Guardianship and Conservatorship Act.
2. Unless otherwise modified or terminated, all guardianships and conservatorships established prior to the effective date of this Act shall remain in full force and effe...
