WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

WHEREAS, several families, who are descendents of Jennie Birdchopper and/or Joe Foreman, are requesting a twenty-five year lease with the option to renew to allow Community Services to do repairs on their residences that are located on certain tracts of land, said tracts of land described as being in the:

W2 NW NE and S/2 NW of Section 16, Township 21 North, Range 24 East, Delaware County

WHEREAS, the above described tract of land is part of the Jennie Birdchopper Scattered Tract, trust land, wherein Joe Foreman, deceased, was the life tenant, and Cherokee Nation possesses a remainderman interest;

WHEREAS, the Cherokee Nation Real Estate Services, in order to enable the descendants of Jennie Birdchopper and/or Joe Foreman to provide acceptable living conditions to their families, wishes to lease portions of the above stated property for a twenty-five year lease with the option to renew in favor of the Birdchopper and/or Joe Foreman families with appraisal being waived as 25 CRF ยง162.604(b)(2) allows the tribe to lease land at a nominal amount for homesite purposes to tribal members provided the land is not commercial or industrial in character. The subject property is not commercial or industrial in character.

BE IT RESOLVED BY THE CHEROKEE NATION, that the Principal Chief, Bill John Baker, and/or his authority designee (s) be authorized to enter in the above described leasing, waiving appraisal and bond, in accordance with Bureau of Indian Affairs policy and procedure for the leasing of land owned by United States of America in Trust for...
