AN ACT RELATING TO AN AMENDMENT TO THE CHEROKEE NATION MEMBERSHIP ACT

BE IT ENACTED BY THE CHEROKEE NATION:
 
Section 1.      Title and Codification
 
      This act shall be known as the Amendment to the Cherokee Nation Membership Act and codified as Title 11, Chapter 4, Section 33 (G) and Section 34 (H) of the Cherokee Nation Code Annotated.
 
Section  2.      Purpose
 
      The purpose of this Act is to provide statutory requirement of providing regular, updated information from the Tribal Registrar to the Cherokee Nation Election commission regarding death notifications and tribal member relinquishments.

Section  4.      Substantive Provisions
 
      Title 11, Chapter 4, Section 33 (G)
 
      G.  The Registrar shall establish a list of death notices that office has received and provide that list to the Cherokee Nation Election Commission on the first day of each month.
      
      Title 11, Chapter 4, Section 34 (H)
 
      H.  The Registrar shall establish a list of tribal member relinquishments and provide that list to the Cherokee Nation Election Commission on the first day of each month.         
 
Section  5.      Provisions as cumulative
 
      The provisions of this act shall be cumulative to existing law.
Section  6.      Severability
 
      The provisions of this act are severable and if any part of provision hereof shall be held void the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this act.
 
Section  7.      Emergency Declared
 
      It being immediately necessary for the welfare of the Cherokee Nation and the upcoming 2013 Tribal Elections, the Council hereby declares that an emergency exists, by reason whereof this Act shall take effect and be in full force after its passage and approval.
