ACT RELATING TO TRADITIONAL, CULTURAL AND LOCAL INFLUENCE OF BUILDING CONSTRUCTION IN THE CHEROKEE NATION

BE IT ENACTED BY THE CHEROKEE NATION:

Section 1. Title and Codification

This act shall be known as the 2013 CULTURAL CONSTRUCTION INFLUENCE ACT and codified as (Title) ______ (Section) ________ of the Cherokee Nation Code Annotated.

Section 2. Purpose

The purpose of this act is to assure that traditional and cultural considerations are included in all new construction or major rehabilitation of any property owned by the Cherokee Nation, Cherokee Nation Business or Cherokee Nation Entertainment along with Councilor influence for any construction or major rehab in their respective districts.

Section 3. Substantive Provisions

A. For all new construction and major rehabilitation projects of any property owned by the Cherokee Nation, Cherokee Nation Business or Cherokee Nation Entertainment, in addition to the tribal department or tribal division or other entities including their boards or committees involved in this construction and rehab projects, the Councilor for the district in which the construction or rehab project is being done shall be included as an advisor for all phases of construction. In addition, to assure the cultural aspects of the projects are included, two traditional and cultural advisors who are citizens of the Cherokee Nation shall serve as advisors as well. One of the traditional and cultural advisors shall be selected by the Councilor of the district in which the construction or rehab is being done. The other traditional and cultural advisor shall be selected by Tribes Executive Branch.

B. The role of these advisors will be as advisors in all phases of construction, including but not limited to the selection of architects and architecture styling and Cherokee cultural significance and correctness of the design plans.
