A RESOLUTION CONFIRMING THE DATES OF THE SPECIAL ELECTION AS TRANSMITTED BY THE CHEROKEE NATION ELECTION COMMISSION

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, an initiative petition calling for a special election to propose an amendment to the Constitution for determining criteria for citizenship into the Cherokee Nation was certified by the Election Commission on September 14, 2006;
WHEREAS, the Cherokee Nation Supreme Court, by Administrative Order #SC-AD-06-06 on October 5, 2006, approved the Election Commission's certification of the numerical sufficiency of signatures on the initiative petition and re-affirmed that decision in SC-06-12;
WHEREAS, the Principal Chief has set the special election for Saturday, March 3, 2007, as authorized by Article XV Section 4 of the Constitution of the Cherokee Nation;
WHEREAS, it is the duty of this Council to confirm the dates for the conducting of the special election as transmitted by the Election Commission, pursuant to Title 26, Chapter 6 ยง 51(C) of the Cherokee Nation Code Annotated.
BE IT RESOLVED BY THE CHEROKEE NATION, that the Council of the Cherokee Nation hereby confirms Saturday, March 3, 2007 as the date of the Special Election and the following dates transmitted by the Election Commission, by memo dated 12/29/2006, for the conduction thereof:
January 11, 2007 - Absentee Ballot Request Opens
February 5, 2007 - Voter Registration Closes
February 7, 2007 - Absentee Ballot Request Closes
February 12 & 13, 2007 - Absentee Ballots Mailed
February 19, 2007 - Red Cards Mailed.
