AN ACT AMENDING LEGISLATIVE ACT 25-01 RELATING TO FREEDOM OF INFORMATION AND RIGHTS TO PRIVACY ACT

BE IT ENACTED BY THE CHEROKEE NATION:
Section 1. Title:
This act shall be known as the “Freedom of Information and Rights to Privacy Agenda Act of 2007” and shall be codified under Title 75 Section 10 in the Cherokee Nation Code Annotated.
Section 2. Purpose
The purpose of this Act is to require public bodies to give adequate advance notice to the public prior to meeting.

Article VI Section 7 of the Cherokee Nation Constitution states: “The Council shall have the power to establish laws which it shall deem necessary and proper for the good of the Nation, which shall not be contrary to the provisions of this Constitution. The style of all bills shall be: “Be It Enacted By the Cherokee Nation”. The Style of all resolutions shall be “Be It Resolved By the Cherokee Nation”.
Section 4. Definitions
For purposes of this Act:
Agenda: means memoranda of items of business or discussions to be brought up at a meeting.
Special Meeting: means any meeting called for the purpose of dealing with any matter that could not be dealt with at a regular meeting
Section 5. Substantive Provisions
Add new section A to Section 10:
A. All public bodies must give written public notice of their regular meetings and special meetings as required by the Constitution and laws of the Cherokee Nation. Provided that agendas must be posted, in accordance with this Act, ten (10) days prior to any regular meeting of a public body of twenty-four (24) hours in case of a special meeting.
Section 6. Provisions as cumulative
The provisions of this act shall be cumulative to existing law.
Section 7. Severability
The provisions of this act are severable and if any part of provision hereof shall be held void the decision of the court so holding shall not affect or impair any of the remaining parts or provisions of this act.
