WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

WHEREAS, Title 23 United States Code, §204(j) provides for tribal determination of its own needs and priorities for the allocation of Federal Highway Indian Reservation Road (IRR) funding;

WHEREAS, the implementing regulations promulgated in 25 CFR Part 170 requires a Transportation Improvement Program (TIP) of projects for the expenditure of IRR funding;

WHEREAS, the following IRR projects have been determined be of the highest priority according to the approved rating system: (1) for matching purposes, that portion of the I-44 and 193rd Street Interchange directly adjacent to the Cherokee Casino, (2) Stick Ross Road Phase II, (3) Northeast Ft. Gibson Extension, (4) Dreadfulwater Road, (5) Kansas-Dry Creek, (6) Pumpkin Hollow Road and related Extensions to include the eastern-most portion of Sawmill Hollow that connects to Proctor-Chewey Road, (7) Nicut North Road, (8) Salina-Kenwood, (9) Greasy Road, and, (10) Nicut Road-Part;

WHEREAS, certain road segments that were previously identified as Nation-priorities are recommended to be removed from the priority list because of other available funding sources or insufficient rights-of-way as follows: (1) the “Jarvis Road” portion of the Rice, Woodard, and Jarvis project, and (2) the EW-82 portion of Northeast Ft. Gibson Road, which lies in between NS-441 and 442 Roads.
