A NEW ACT RELATING TO CHEROKEE NATION OF OKLAHOMA LAW REGARDING HANDLING OF SPOILED BALLOTS ADDING NEW ITEMS: AND DECLARING AN EMERGENCY

BE IT ENACTED BY THE CHEROKEE NATION:
*10-5-49a Handling of ballots spoiled in part or in whole.
Each absentee ballot card shall be considered as a separate ballot for each of the three races for Chief, Deputy Chief, and Council and any special question presented. Therefore an absentee ballot card which is spoiled as to one race shall be examined to determine if it was correctly voted as to the other races. If so, it shall be valid as to those races.
Each ballot card voted in person but spoiled as to any race shall be invalid in its entirety when rejected by a vote counting machine. The precinct inspector will retrieve and retain the invalid card and provide the voter with another card. Provided however that when votes are not counted by machine the ballot card shall be spoiled and invalid only as to that race for which it was incorrectly voted.
