A RESOLUTION AUTHORIZING AN APPLICATION TO THE FEDERAL HIGHWAY ADMINISTRATION FOR TRIBAL TRANSPORTATION PROGRAM BRIDGE FUNDING FOR BRIDGE #84 OVER A TRIBUTARY TO THE CANEY RIVER IN WASHINGTON COUNTY, OK

Body

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people; and

 

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America; and

                     

WHEREAS, The Fixing America’s Surface Transportation Act (FAST Act) provides funding to repair or replace bridges on the Tribal Transportation Facility Inventory; and

 

WHEREAS, Title 23 United States Code, as amended by the FAST Act, specifies the eligibility requirements for Tribal Transportation Program Bridge funding; and

 

WHEREAS, Bridge #84 over a tributary to the Caney River is located on Cherokee Nation’s Tribal Transportation Facility Inventory; it is recorded in the National Bridge Inventory and is structurally deficient; and

 

WHEREAS, Bridge #84 over a tributary to the Caney River provides crucial access for many Cherokee citizens and is hereby identified as a candidate for replacement.

 

BE IT RESOLVED BY THE CHEROKEE NATION, that the Federal Highway Administration is hereby authorized to pursue all matters necessary to fund the replacement of Bridge #84 over a tributary to the Caney River, which is herein deemed a priority for the Tribal Transportation Bridge Program.
