A RESOLUTION FOR THE COUNCIL OF THE CHEROKEE NATION TO REQUEST A CONFIDENTIAL REPORT MONTHLY OF ALL CHARITABLE DONATIONS AND SURPLUS EQUIPMENT OF ALL SUBSIDIARIES IN THE CHEROKEE NATION
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

WHEREAS, pursuant to The Cherokee Nation Constitution, Article X, Section 2 of the Constitution’s Fiscal Division, The Council of the Cherokee Nation is to provide by law for annual expenditures of funds, the source from which funds are to be derived for all government branches and the departments of government of the Cherokee Nation for each fiscal year. This also applies to Cherokee Nation’s governance regarding tribal businesses such as Cherokee Nation Business and Cherokee Nation Industries.

WHEREAS, The Tribal Council wishes to be provided with a confidential monthly report of any charitable expenditures or surplus equipment and sale of surplus owned by Cherokee Nation Businesses, or subsidiaries, thereof. Furthermore, the Tribal Council wishes to be provided notice in advance of all such proposed transactions exceeding $50,000. Furthermore, the Tribal Council wishes to be included in the report details of any addition commitment relating to donation regardless if commitment is in the same reporting period.

WHEREAS, the Council passes this resolution to include their authority for all items listed above.
