A RESOLUTION AUTHORIZING ACCEPTANCE OF LAND FROM OKLAHOMA DEPARTMENT OF TRANSPORTATION

Body

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;

 

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

 

WHEREAS, Cherokee Nation acquired property known as Sequoyah’s Cabin in Sequoyah County, Oklahoma.   The entrance road is currently owned by the Oklahoma Department of Transportation (ODOT).   Cherokee Nation desires transfer of this ODOT land to Cherokee Nation to secure permanent access to Sequoyah’s Cabin and Museum site and to enable road maintenance and upkeep of the tract of land to be the responsibility of Cherokee Nation.   The transfer of land from Oklahoma Department of Transportation shall include a part of the S2 SW4 NW4 in Section 15, Township 12 North, Range 25 East, I.B.&M., Sequoyah County comprising less than three acres.  ODOT constructed highway project State Aid Project No. 243(1) and acquired the property under deeds recorded in Sequoyah County land records in Book 134 at Pages 501 and Book 217 at Page 478.

 

WHEREAS, Cherokee Nation desires Oklahoma Department of Transportation to remove this section of roadway from the ODOT highway system and turn jurisdiction over to and transfer title of the subject parcel to Cherokee Nation. 

 

BE IT RESOLVED BY THE CHEROKEE NATION, that the Principal Chief of Cherokee Nation, Bill John Baker, and/or his authorized designee(s) be authorized to accept said tract of land from the Oklahoma Department of Transportation.
