A RESOLUTION AUTHORIZING THE PLACEMENT OF LAND IN TRUST - BECK'S MILL 39.2 ACRES IN DELAWARE COUNTY

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, Cherokee Nation acquired property in Delaware County, Oklahoma. The property has a rich history as a trading post with a grain mill being operated in the 1800s. The property known as Beck’s Mill is located along Flint Creek in southern Delaware County. The property is north of Highway 412. There are no intact remaining structures of Beck’s Mill Trading Post or Mill. The Delaware County property is further described as follows:
Indian Meridian, Oklahoma, Delaware County
Township 20 North, Range 24 East,
Section 24, Part SW4 NW4, more particularly described as follows:
A tract of land in the NW1/4 BEGINNING at a POINT on the southwest corner of the SW4 NW4;
THENCE, east 1300 feet;
THENCE north 81.83 feet;
THENCE west 1300 feet;
THENCE south 81.83 feet to the POINT OF BEGINNING (Warranty Deed recorded at Book 1966, Pages 299-300);
AND
N2 NW4 SW4, LESS AND EXCEPT the east 20 feet of the N2 NW4 SW4 (Warranty Deed recorded at Book 1966, Pages 299-300);
AND
S2 NW4 SW4, Subject to an existing Road (Filed at Book 106, Page 164), LESS AND EXCEPT the east 20 feet of the NW4 SW4, (Warranty Deed recorded at Book 1966, Pages 301);
AND
LESS AND EXCEPT a tract of land in the NW4 SW4 more particularly described as follows, to-wit:
BEGINNING at the southwest corner of NW4 SW4;
THENCE, approximately 246 feet east along the south boundary of NW4 SW4 to the west end of Old State Highway #33 bridge across Flint Creek;
THENCE, meandering northerly along the edge of the Bluff forming the west shoreline of said Flint Creek approximately 529 feet to a certain iron pin, which is the POINT OF BEGINNING;
THENCE, west to the west side of NW4 SW4;
THENCE, south along the west side of NW4 SW4, a distance of 177 feet;
THENCE, east to the edge of said Bluff forming the west shoreline of Flint Creek;
THENCE, northerly along the west edge of said Bluff to the POINT OF BEGINNING

LESS AND EXCEPT a tract of land in the NW4 SW4, more particularly described as follows, to-wit:
COMMENCING at the southwest corner of NW4 SW4;
THENCE, approximately 246 feet east along the south boundary of NW4 SW4 to the west end of the Old State Highway #33 bridge across Flint Creek;
THENCE, meandering northerly along the edge of the Bluff forming the west shoreline of Flint Creek, a distance of approximately 529 feet to a certain IRON PIN;
THENCE, west to the west side of the NW4 SW4;
THENCE, south along the west side of NW4 SW4, a distance of 177 feet to the POINT OF BEGINNING;
THENCE, south along the west side of the NW4 SW4 a distance of 84 feet; THENCE, east to the waters edge of Flint Creek;
THENCE, meandering in a northerly direction along the waters edge to a POINT due east of the POINT OF BEGINNING;
THENCE west to the POINT OF BEGINNING (Warranty Deed recorded at Book 1966, Pages 301);

LESS AND EXCEPT a tract of land in the NW4 SW4, more particularly described as follows, to-wit:
BEGINNING at the southwest corner of the said NW4 SW4;
THENCE, north 268 feet;
THENCE, east 2225 feet to the edge of the Bluff, said Bluff forming the west shoreline of Flint Creek;
THENCE, in a southerly direction along the edge of the Bluff forming the west shoreline of Flint Creek to the south Section Line of said NW4 SW4;
THENCE, west 246 feet to the POINT OF BEGINNING(Warranty Deed recorded at Book 1966, Pages 301);

WHEREAS, Cherokee Nation desires to transfer fee title to United States of America in Trust for Cherokee Nation under the provisions of Title 25 of the Code of Federal Regulations.
BE IT RESOLVED BY THE CHEROKEE NATION, that the Principal Chief of Cherokee Nation, Bill John Baker, and/or his authorized designee(s) be authorized to request the Secretary of the Interior to place said tracts of land in Trust for Cherokee Nation in accordance with Bureau of Indian Affairs policy and procedure for the acquisition of land.
