DISCUSSION ONLY - A RESOLUTION REGARDING A BALLOT QUESTION ON WHETHER TO CALL A CONSTUTIONAL CONVENTION

WHEREAS, the Cherokee Nation since immemorial has exercised its sovereign power of self-government on behalf of the Cherokee people; and
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, Article XV, Section 9, of the Constitution of Cherokee Nation states that the question of whether or not to call a constitutional convention must be submitted to the members of Cherokee Nation at least once every twenty (20 years); and
WHEREAS, the question of whether to call a constitutional convention has not yet been submitted to the people since the June 1995 general election; and
WHEREAS, the Cherokee Nation will be conducting its general elections June 01 of 2019, at which time the question of whether or not to call a constitutional convention should be placed on the ballot for a referendum vote.
NOW, THEREFORE, BE IT RESOLVED by the Council of Cherokee Nation that a referendum question of whether or not to call a constitutional convention should be prepared and submitted to the duly qualified, registered voters of the Cherokee Nation by placing such question on the election ballot for the general election to be held June 01 of 2019, and that said question should read as follows:
REFERENDUM ON CONSTITUTIONAL CONVENTION
Article XV, Section 9, of the Cherokee Nation Constitution, states that the question of whether or not to call a constitutional convention to propose adopting amendments or a new constitution must be submitted to the members of Cherokee Nation at least once every twenty (20) years. Therefore:
SHOULD A CONVENTION BE CALLED TO PROPOSE ANY CONSTITUTIONAL AMENDMENTS, ALTERATIONS, REVISIONS OR A NEW CONSTITUTION?
