A RESOLUTION CONFIRMING THE NOMINATION OF SHAWNA BAKER AS A JUSTICE OF THE CHEROKEE NATION SUPREME COURT

Body

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;

 

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

 

WHEREAS, Justices of the Supreme Court are authorized in Article VIII Section 1 of the Constitution of the Cherokee Nation;

 

WHEREAS, according to Article VIII Section 2 of the Constitution, the Justices shall be appointed by the Principal Chief and confirmed by the Council of the Cherokee Nation;

 

WHEREAS, the passing of Justice Lynn Burris left a vacancy;

 

WHEREAS, the Principal Chief has nominated Shawna Baker as a Justice of the Supreme Court of the Cherokee Nation to fulfill the duties of Justice as articulated in Article VIII of the Constitution;

 

WHEREAS, Baker will fulfill the remainder of the term set for the late Justice Lynn Burris;

 

WHEREAS, Shawna Baker is duly qualified to fill this position.

 

BE IT RESOLVED BY THE CHEROKEE NATION, that Shawna Baker is hereby confirmed as a Justice of the Supreme Court of the Cherokee Nation to fulfill the duties of Justice as specified in Article VIII of the Constitution of the Cherokee Nation for a term beginning August 28, 2020 and ending December 31, 2024.
