A RESOLUTION AUTHORIZING THE CHEROKEE NATION TO EXTEND THE SECTION 184 LOAN PROGRAM SERVICES TO CHEROKEE CITIZENS LIVING IN THE STATE OF TEXAS AND THE STATE OF ARKANSAS
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

Whereas, this proposal, as submitted, is intended to recognize and be consistent with the Cherokee Nation’s Sovereign Right to Self Determination by their request to participate in the Section 184 Loan Program within the State of Texas and the State of Arkansas;

Whereas, it is the Cherokee Nation’s desire that its citizens be able to apply for “financing for the construction and/or purchase of family residences on fee simple or trust land within the jurisdiction of the Nation by prescribing procedures for the recording, priority, and foreclosure of leasehold mortgages given to secure loans made by private lenders and fully guaranteed by the U.S. Department of Housing and Urban Development under the Indian Housing Loan Guarantee Program authorized under Section 184 of the Housing and Community Development Act of 1992,” as amended by the Native American Housing Assistance and Self-Determination Act of 1996 (NAHASDA), Pub. L. 104-330 (Hereinafter referred to as “Section 184”);

Whereas, it is evident that the Cherokee Nation has citizens residing in the State of Texas and the State of Arkansas;

Whereas, the Cherokee Nation recognizes the need to provide its citizens with the ability to utilize the Section 184 Loan Programs as means to prevent predatory lending and ensure the financial security of Cherokee citizens located in the State of Texas and the State of Arkansas;
