A RESOLUTION DEMONSTRATING SUPPORT FOR UNITED STATES SENATE BILL 1265 THE “FOURTH AMENDMENT IS NOT FOR SALE” ACT

WHEREAS the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS United States Senator Ron Wyden [D-OR] has sponsored Senate Bill 1265 which was introduced before the Senate Judiciary Committee on April 21, 2021, otherwise known as the “Fourth Amendment Is Not For Sale Act”;
WHEREAS the “Fourth Amendment Is Not Sale Act” would amend 18 U.S.C.A. § 2702 to prevent law enforcement and intelligence agencies from obtaining subscriber or customer records in exchange for anything of value, to address communications and records in the possession of intermediary internet service providers, and for other purposes.
BE IT RESOLVED BY THE CHEROKEE NATION, that Tribal Council of the Cherokee Nation hereby supports the passage and signing into law of Senate Bill 1265, otherwise known as the “Fourth Amendment Is Not For Sale” Act.
