A RESOLUTION AUTHORIZING THE PRINCIPAL CHIEF TO SUBMIT CERTAIN GRANT APPLICATIONS AND EXECUTE CERTAIN GRANT AWARDS

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

WHEREAS, the Cherokee Nation applies for and receives millions of dollars in grant funding every year from the federal, state, and local government, and private organization Many of those grant applications and grant awards require the Cherokee Nation to consent to suit, jurisdiction, binding dispute resolution, specific performance, and other legal relief in relation to the expenditure of grant funds.

WHEREAS, certain grant submissions and awards may require authorization from the Council of the Cherokee Nation prior to execution pursuant to Article X, Section 7 of the Cherokee Nation Constitution; 62 CNCA ? 61; 73 CNCA ? 4; and 73 CNCA ? 310 et seq.; and

WHEREAS, the Council of the Cherokee Nation wishes to expedite the submission and acceptance of award of certain grant applications and funds. This includes application for and award from the federal, state, and local government, and private organization for grant funds that require the Cherokee Nation to consent to suit, jurisdiction, binding dispute resolution, specific performance, and other legal relief in relation to the expenditure of grant funds.

BE IT RESOLVED BY THE CHEROKEE NATION, that the Council of the Cherokee Nation authorizes the Principal Chief or his designee, who is chosen from the cabinet, to submit grant applications and execute grant award agreements that would otherwise require prior approval by the Council of the Cherokee Nation pursuant to Article X, Section 7 of the Cherokee Nation Constitution; 62 CNCA ? 61; 73 CNCA ? 4; and 73 CNCA ? 310 et seq. ...
