A RESOLUTION AUTHORIZING SUPREME COURT JUSTICE SHAWNA BAKER TO SERVE AS AN ASSOCIATE SUPREME COURT JUSTICE WIT THE KICKAPOO TRIBE OF OKLAHOMA

Body

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people; and

 

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with an historic and continual government to government relationship with the United States of America; and

WHEREAS, the Cherokee Nation’s Constitution states at Article IX, Section 2 that, “[a]ny person who holds any office of honor, profit or trust in any other tribe or Nation of American Indians, either elective or appointive shall be ineligible to hold simultaneously any office of honor, profit or trust of the Cherokee Nation unless approved by the Council;” and

WHEREAS, the Cherokee Nation’s Council has the authority by virtue of the Constitution to determine whether Justice Shawna Baker may simultaneously hold the office of Cherokee Nation Supreme Court Justice and Associate Supreme Court Justice with the Kickapoo Tribe of Oklahoma; and

 

WHEREAS, the Council sees no impediment to Justice Baker simultaneously serving as both a Justice of the Cherokee Nation Supreme Court and an Associate Justice of the Kickapoo Tribe and hereby approves the same;

 

BE IT RESOLVED BY THE CHEROKEE NATION, that the Tribal Council hereby authorizes Justice Shawna Baker to hold the office of Justice of the Cherokee Nation simultaneous with the office of Associate Justice of the Kickapoo Tribe.
