AN ACT AWARDING SCHOLARSHIPS TO CHEROKEE NATION STUDENTS WHO ARE ACCEPTED TO THE MILITARY SERVICE ACADEMIES OF UNITED STATES

BE IT ENACTED BY THE CHEROKEE NATION:

Section 1. Title and Codification

This act shall be known as the “Military Service Academy Scholarship Act of 2010” and codified as _____________ (Title) ___________ (Section) ______________ of the Cherokee Nation Code Annotated.

Section 2. Purpose

The purpose of this Act is to award scholarships to Cherokee Nation students who are accepted in military service academies of the United States. These scholarships shall only be awarded once to a student and shall be used to pay cost or fees not covered by any other scholarship.

Section 3. Legislative History

Article VI, Section 7 of the Cherokee Nation Constitution states: “The Council shall have the power to establish laws which it shall deem necessary and proper for the good of the Nation, which shall not be contrary to the provisions of this Constitution. The style of all bills shall be: “Be It Enacted By the Cherokee Nation”. The style of all resolutions shall be “Be It Resolved By the Cherokee Nation””.

Section 4. Definitions

Military Service Academy means:

The United States Air Force Academy; the United States Naval Academy; the United States Military Academy (West Point) and the United States Coast Guard Academy.


Section 5. Substantive Provisions of Law

A. The Cherokee Nation Department of Higher Education shall award scholarships up to the amount of three thousand dollars ($3,000.00) to any student who is a citizen of the Cherokee Nation who is accepted into a military service academy of the United States.

B. These scholarships shall only be awarded once to a student and shall be used to pay any cost or fees not otherwise paid by other scholarships

Section 6. Provisions as cumulative

The provisions of this act shall be cumulative to existing law.
