A RESOLUTION IN SUPPORT OF THE LOST CITY HOUSING, COMMUNITY AND PUBLIC HEALTH AND WELLNESS RESERVE

WHEREAS, the Cherokee Nation (“Nation”) since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, the Nation has exclusive tribal jurisdiction over the Cherokee Nation Reservation, the geographic scope of which is defined in federal and Cherokee Nation law.
WHEREAS, Cherokee Nation has acquired certain real property located at 13242 N. Lost City RD, Hulbert, OK 74441, more specially described as follows,
Lot 1, Section 2, Township 17 North, Range 20 East of the Indian Base and Meridian, Cherokee County, State of Oklahoma. LES and EXCEPT: A 5.57 acre tract of land described as being the Lost City Addition, conveyed by the Housing Authority of the Cherokee Nation of Oklahoma, being more particularly described as follows: BEGINNING at the Northwest Corner of Lot 1 Section 2, Township 17 North, Range 20 East of the Indian Base and Meridian, Cherokee County, State of Oklahoma, Thence East a distance of 457.42 feet; Thence South a Distance of 417.42 feet; Thence West a distance of 208.71 feet; Thence West a distance of 208.71 feet; Thence North a distance of 626.13 feet to the POINT OF BEGINNING.

LES AND EXCEPT; A tract of land located in Lot 1, Section 2, Township 17 North, Range 20 East of the Indian Base and Meridian, Cherokee County, State of Oklahoma, being more particularly described as follows: Commencing at a found railroad spike at the Northeast corner of said Section 2; Thence S0°0l'00"E, a distance of 25.08 Feet; Thence N85°47'45"W, a distance of 23.99 Feet to a set 3/8" iron rod; Thence continuing N85°47'45"W, •a distance of 264.02 feet to a set 3/8" iron rod, said point being the Northeast property corner and the True POINT of BEGINNING; Thence continuing N85°47'45"W, a distance of 125.3.6 feet to a set 3/8" iron rod; Thence S05°51'09"W, a distance of 108.27 Feet to a set 3/8" iron rod; Thence S8S0 47'45"E,.a distance ofJ25.36 feet to a set 3/8" iron rod; Thence N0S051'09"E, a distance of 108.27Feet to the POINT of BEGINNING.
SUBJECT TO A ROAD EASEMENT DESCRIBED AS FOLLOWS: A 25.00 Foot wide strip of land for the purpose of ingress and egress over across and through Lot 1, Section 2, Township 17 North, Range 20 East of the Indian Base and Merdan, Cherokee County, State of Oklahoma, said strip of land being more particularly described as follows: Commencing at a found railroad spike at the Northeast corner of said Section 2; Thence S0°0l'00"E, a distance of 973.03 Feet to the POINT of BEGINNING; Thence continuing S00°0l'00"E, a distance of 25.08 Feet; Thence N85°47'45"W, a distance of 23.99 Feet to a set 3/8" ion rod; Thence continuing N8S047'45"W, a distance of 264.02 feet to a set 3/8" iron rod; Thence continuing N85°47'45"W, a distance of 125.36 Feet to a set 3/8" iron rod; Thence N0'19'47"E, a distance of 25.08 feet to a set 3/8" iron rod; Thence S85°47'45"E, a distance of 389.07 Feet to a set 3/8" iron rod; Thence continuing S85°47'45"E, a distance of 24.15 Feet to the POINT of BEGINNING.
WHEREAS, Cherokee Nation has made funds available to support community wellness infrastructure that can include public recreation, community centers, housing and adjacent assets to support health and safety under the Housing, Jobs and Sustainable Communities Act (HJSCA) and the Public Health and Wellness Fund Act (PHWFA);
WHEREAS, HJSCA and PHWFA authorized the Principal Chief to administer funds authorized and appropriated under those Acts for the purposes and policies of those Acts;
WHEREAS, the Council finds it to be the highest and best use of the Lost City property described above for public health and wellness infrastructure, community facility and / or housing;
WHEREAS, Cherokee Nation reserves the Lost City property described herein as a “Housing, Community and Public Health and Wellness Reserve” consistent with this resolution, HJSCA and PHWFA for a period of seven (7) years following approval of this resolution, encouraging development of the property to those purposes;
WHEREAS, the Principal Chief shall provide the Council with periodic updates as to the development plans for the Lost City property, no less than once per fiscal year;
WHEREAS, nothing herein reduces the authority of the Council, including its authority to appropriate funds, provide oversight of executive branch functions and to name property and facilities;
BE IT THEREFORE RESOLVED that the Cherokee Nation declares property described herein in Lost City as the “Lost City Housing, Community and Public Health and Wellness Reserve,” with the Council retaining relevant authority and the Principal Chief providing updates on the development of the properly no less than annually.
