Title
A RESOLUTION AUTHORIZING THE SALE OF A HOUSE TO THE JAMES BEAVER FAMILY LOCATED IN LOCUST GROVE, OKLAHOMA, MAYES COUNTY
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

WHEREAS, Cherokee Nation purchased a house through an emergency assistance program which was on approximately 0.85 acre in the Locust Grove rural area, legal description in Mayes County as follows:

A tract of land in the NE NE SE of Section 13, Township 19 North, Range 19 East of the Indian Base and Meridian, more particularly described as follows:  Beginning at a point 251.80 feet South along the Section line and 33 feet West along a line parallel to the North line of the NE NE SE of Section 13, from the Northeast Corner of the SE of Section 13, Township 19 North, Range 19 East, thence 337 feet West along a line parallel to the North line of the NE NE SE of Section 13, thence 109.40 feet South along a line parallel to the East line of the NE NE SE of Section 13, thence 337 feet East along a line parallel to the North line of the NE NE SE of Section 13, thence 109.40 feet North along a line parallel to the East line of the NE NE SE of Section 13, to the point of beginning;

At the time, an elderly Cherokee Citizen was residing in the home and in danger of being made homeless.  The home was purchased as a foreclosure sale for the sum of $29,666.67, which was two-thirds of the appraised value at that time.  Recently, the house was reappraised and the value was placed at $34,000.00.
WHEREAS, the elderly Cherokee that resided in the home has passed away and members of his family has requested the opportunity to purchase their home from the Cherokee Nation.  This house is in a rural setting that would make it difficult to find an adequate renter and continual monitoring and care of the property will cost more than any income produced.  Therefore, it would be in the best interests of the Cherokee Nation to allow a member of the James Beaver family to purchase the house at a sum equal to or more than Cherokee Nation's original purchase price.

      BE IT RESOLVED BY THE CHEROKEE NATION, that the Principal Chief of the Cherokee Nation, Bill John Baker, and/or his authorized designee(s) be authorized to negotiate and sell said house and parcel of land, in accordance with the laws and regulations of Cherokee Nation and the State of Oklahoma.
