A RESOLUTION IN SUPPORT OF INVOKING SECTION 16 OF THE CHEROKEE NATION AND STATE OF OKLAHOMA TOBACCO COMPACT OF 2004
Body
WHEREAS,      the Cherokee Nation, since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee People; and
 
WHEREAS,       the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America; and
 
WHEREAS,       the Cherokee Nation and the State of Oklahoma have entered into a Tobacco Compact in 2004 for the sell of tobacco products on Indian Country; and
 
WHEREAS,       Section 16 of said Compact allows for the Cherokee Nation to invoke "More Favorable Terms" of any other compact that the State of Oklahoma may have with any other Indian Nation; and
 
WHEREAS, it would be beneficial to the economy of the Cherokee Nation to invoke and incorporate "More Favorable Terms" of Tobacco Compacts.
 
WHEREAS,       the Kaw Nation has renewed its compact with the State of Oklahoma that has a More Favorable Tax Clause.
 
BE IT RESOLVED BY THE CHEROKEE NATION that the Council supports and encourages the implementation of Section 16 of the Cherokee Nation and State of Oklahoma Tobacco Compact invoking the "More Favorable Terms" clause and incorporating those sections in the Kaw Compact, which inure to the benefit of the Cherokee Nation Tobacco Tax rates.
