A RESOLUTION AUTHORIZING CHEROKEE NATION TO LEASE TRIBAL TRUST LAND IN THE CHEROKEE NATION INDUSTRIAL PARK TO THE CHERRY TREE RURAL WATER DISTRICT, INC.
Body
WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government in behalf of the Cherokee people;

WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;

WHEREAS, the Cherry Tree Rural Water District wishes to lease a 2.42 acre tract for an Office and Shop to improve their sustainability and serve as a hub for operations and maintenance of the water district, which serves a predominantly Cherokee customer base. The lease will be for a term of twenty-five (25) years, with an option to renew for an additional twenty-five (25) years. The annual rent for the lease will be one hundred dollars ($100.00) per year. The tract of land is described as follows: The East 250 feet of the SE NE SW lying south of the Industrial Park road in Section 23, Township 15 North, Range 25 East, I.B.&M. Adair County Oklahoma, AKA the East 250 feet of Lot 5 of the Cherokee Nation Industrial Park, containing 2.42 acres more or less.

WHEREAS, Cherokee Nation Real Estate Services requests the Tribal Council to issue a waiver of said regulation requiring bonds on Cherokee Tribal Land Leases pursuant to regulations contained in 25 CFR ?162.434(f)(g). Cherokee Nation has determined that a waiver of performance bond or alternative form of security is in the best interest of the tribe, and;

WHEREAS, The Cherokee Nation requests a Waiver of Valuation and that the Negotiated Value be used pursuant to 25 CFR ?162.420(a).

2. Cherokee Nation waives valuation; and
3. Cherokee Nation has determined that accepting such negotiated compensation and waiving valuation is in the best interest of...
