A RESOLUTION APPOINTING KENDRA MCGEADY TO FILL THE VACANCY IN THE TRIBAL COUNCIL SEAT FOR DISTRICT 11 RESULTING FROM THE RESIGNATION OF TRIBAL COUNCIL MEMBER VICTORIA VAZQUEZ

WHEREAS, the Cherokee Nation since time immemorial has exercised the sovereign rights of self-government on behalf of the Cherokee people;
WHEREAS, the Cherokee Nation is a federally recognized Indian Nation with a historic and continual government to government relationship with the United States of America;
WHEREAS, Article VI, Section 13 of the Cherokee Nation Constitution, in pertinent part, provides that upon the resignation of any of Council member with one year or less of the Council member’s four-year term remaining, the Tribal Council shall elect a replacement who would otherwise be qualified to serve from the district of the vacated seat;
WHEREAS, Title 19, Section 3 provides that eligible applicants may seek appointment by the Tribal Council to fill the vacated seat after having been determined to meet the eligibility criteria set forth therein, appearing before the Rules Committee for interviews, and a majority vote forwarding their name to the next regular Tribal Council meeting for consideration and a vote;
WHEREAS, it is the determination of the Tribal Council that Kendra McGeady is eligible for appointment to fill the vacancy in the Tribal Council seat for District 11 resulting from the resignation of Tribal Councilor Victoria Vazquez and to serve the remainder of the unexpired term of office for such seat until the next General Election.
BE IT RESOLVED BY THE CHEROKEE NATION, that Kendra McGeady is hereby appointed to fill the Tribal Council seat for District 11 and shall serve the unexpired term of office for such seat until the next General Election.
